Bombay High Court on Monday rejected a plea by the applicants who had been unqualified for the law clerk Recruitment, advertisement on the basis that their colleges have lost affiliation from UGC. Mumbai University is a recognized university “unquestionably”. The court directed to Madhav Ved, one who was rejected among the 687 applicants.
A dispute between the applicants and the recruitment authority for Law Clerk, advertised in March 2023 took place in High Court yesterday. The Authority had rejected the 687 candidates’ applications stating that their colleges have not been recognized by the University Grant Commission (UGC). Madhav Ved, a Law graduate from Praveen Gandhi College of Law, Mumbai had filed a plea in the High Court for the relief. He submitted a notary that he was rejected on 12 April while 9 of 20 Candidates were accepted on 9th of May.
Senior Counsel Milind Sathe, for the Registrar General, filed an argument that UGC informed us in a query that Praveen Gandhi Law College has not been recognized under the Section 2(f) (University) of the UGC Act. Here honourable High Court made an important statement- “This exemplifies that ‘Ask a wrong question and you will get a wrong Answer”. The High Court clarified that Praveen Gandhi Law College is an affiliated college to the University of Mumbai, which is recognized by UGC “unquestionably”. Reminding the fact the court said – “UGC recognition is only for those which are a Univerity or Deemed to be University level HEIs.” A college affiliated to a recognized university need not have another certification.
The court rejected the plea saying that if a Law College is not recognized by the UGC Act it has “another option to get approval from the President, Bar Association of India ”.
